What she has said is that halting of funds to ACORN was illegal and that the funds should immediately be made available to the organization. The statement that likened and was the cornerstone of the verdict was that the halting of funds amounted to a "bill of attainder". A Bill of Attainder means that the halting of funds was punishment for a crime committed without the benefit of a trial. Basically, the halting of funds was punishment and declaration of guilt for the ACORN organization with how they dealt with the Pimp and Prostitute senario. The problem I have with the verdict is that they were not punished for a crime. The videos themselves do not put them into a position to commit a crime. Now, they certainly did show that the organization has many in it that need help with their moral compuses. Congress pulled funding for ACORN and made no statements on an intent to punish the organization. Additionally, many organizations have funding pulled from them and it is not a universally known tool of punishment by congress. ACORN has had several acts of violation of election laws on state and federal levels...enough to immediately suspend funding. ACORN has also been found, in a congressional report, that QUOTE "structurally and operationally, ACORN hides behind a paper wall of nonprofit corporate protections to conceal a criminal conspiracy on the part of its directors, to launder federal money." It intentionally blurs "the legal distinctions between 361 tax-exempt and non-exempt entities [in order to divert] taxpayer and tax-exempt monies into partisan political activities." We probably shouldnt even mention congresses allowance for descretionary spending. So I can see it you just look at the Pimp and Prostitute videos that you would say that they were being punished for the behavior shown in them...but they werent accused of a crime. If you know a bit more about the organization, then you will see that there were many more reasons for the defunding. For me, it comes down to Congressional descetionary spending. Those are MY dollars, that I have allowed my representatives to spend on MY behalf and to react in ways that the majority of the constituency would appreciate and want when descretionary spending is being determined. ACORN made themselves vulnerable for review with the Pimp and Prositute videos and their body of work showed they were not worthy of funding. As best I can see, this verdict by the judge did not meet the requirements to be considred a bill of attainder. They are trying to subvert the constitution and this ruling should be struck down by a superior court. The only good thing is that she asked for funding to be resumed...congress should pass on this one. [See Similar Topics]
